General Terms and Conditions for Consumers

General Terms and Conditions of Danto GmbH for Consumers

1. It is agreed upon between the provider and the consumer that the consumer must bear the costs of returning the product when exercising his right to cancel, if the price of the items being returned is not more than 40 Euros, or if the cause of the return for the consumer is a higher price than the item, or if a contractually agreed-upon partial payment at the time of withdrawal has not yet been rendered, unless the delivered goods were not the goods ordered.

2. Regarding the rights of the buyer with regards to a defect, the following is agreedupon:

(1) The rights of the buyer with regards to a purchased, used item fall under the statute of limitations within 12 months of the passing of the risk.

(2) Exceptions to this are the following damage claims of the buyer within the statutory limitation period after the transfer of risk:

(2a) due to an injury to life, the human body or health, based on an intentional or negligent breach of duty by Danto GmbH or by an intentional or negligent breach of duty by the legal representatives or vicarious agents;

(2b) those reasons that apply to such contratual obligations, that enable the fulfillment of the contract through proper execution in the first place, and that may regularly rely on their compliance with the contracting party;

(2c) for reasons of other damages caused by an intentional or grossly negligent breach of duty by Danto GmbH or by an intentional or grossly negligent breach of duty by the legal representative or vicarious agent;

(2d) or based on any liability under the Product Liability Act;

3. In addition, the statutory provisions apply.
